At Shoparino8, we are dedicated to safeguarding intellectual property rights and have established a comprehensive policy to that effect. This Intellectual Property Policy outlines how we address allegations of infringement, the process for authorized parties to submit infringement reports concerning content on our website and mobile applications, and the procedures for responsible parties to respond when their listings are affected by such reports. We will remove material subject to alleged intellectual property infringement upon receipt of a valid report that complies with our policies. For the purposes of this policy, intellectual property includes copyrights, trademarks, patents, and other rights recognized under applicable laws.
2Reporting Infringement
- To submit a notice of intellectual property infringement, you must be either the rights owner of the intellectual property in question or an authorized agent acting on behalf of the rights owner.
- Upon receipt of a report, we will investigate the listings or content cited. Reports must be submitted in good faith and include a sworn statement under penalty of perjury.
- Submission of infringement notices requires you to submit a letter to our office. Reports should include the following information:
- Precise identification of the intellectual property claimed to be infringed, such as registration numbers, written descriptions, links to the original work, dates of first use/publication, etc.
- Description of the nature of the infringement (e.g., product, packaging, images, text on product pages).
- URLs of the infringing products.
- Identification of the infringing parties.
- Supporting documentation or additional information to assist in complaint resolution (e.g., order IDs for any test purchases).
- Complainant’s contact information (name, address, phone number, email).
- Any additional information required by relevant law.
- We may request further information or documentation to verify rights ownership and substantiate the claim before processing the report.
3Reporting Copyright Infringement under the DMCA
(The DMCA stands for the Digital Millennium Copyright Act. It is a U.S. federal law enacted in 1998 that aims to protect copyright owners in the digital environment.)
- Copyright owners or authorized agents may submit infringement notices via mail to our office address, which must include:
- A physical or electronic signature of the authorized representative.
- Identification of each copyrighted work alleged to be infringed. Multiple works may be included in one notice.
- Identification and location of the infringing material to be removed or disabled, sufficient to permit us to locate it.
- Contact information for the complainant, including address, phone number, and email.
- A statement asserting good faith belief that the use of the material is unauthorized.
- A representation, under penalty of perjury, that the information in the notice is accurate and that the complainant is authorized to act on behalf of the copyright owner.
- Misrepresentations in infringement claims may result in liability for damages. If uncertain about infringement, please seek legal advice before submitting a notice.
- Upon acceptance of a valid notice, we will remove the infringing content and take appropriate action against responsible parties. Details of enforcement actions will not be disclosed unless already public.
- We enforce a repeat infringer policy and may terminate accounts of users who repeatedly infringe intellectual property rights.
- We encourage the use of the Shoparino8 IP Portal for submitting DMCA notices for efficient processing. If unable to use the IP Portal, notices can be submitted directly to our office with the required information below:

4Counter-Notice to Copyright Infringement Claims under the DMCA
- If a content provider believes that material removed or disabled is not infringing or is authorized, they may submit a counter-notice including:
- A physical or electronic signature of the content provider.
- Identification of the removed or disabled material and its prior location.
- A statement under penalty of perjury that the material was removed due to mistake or misidentification.
- Contact information (name, address, phone number, email).
- Consent to jurisdiction of the Federal District Court in the provider’s district or any judicial district where Shoparino8, Inc. may be found, and agreement to accept service of process.
- Upon receipt of a valid counter-notice, we will take appropriate action in compliance with the DMCA.
5Withdrawal of Reports
The rights owner or authorized agent may withdraw a previously submitted infringement report by mail to our office address. Withdrawal requests must clearly identify the original report, including complainant details, the intellectual property involved, and the material subject to withdrawal.
6False or Fraudulent Notices
- We reserve the right to reject any reports that are false, fraudulent, incomplete, or submitted in bad faith. We may also take appropriate action against those who abuse this policy or applicable law.
- Repeated submission of inaccurate or fraudulent notices may result in suspension or revocation of submission privileges.
